Legal basis of the contest
1. PURPOSE OF THE CONTEST
HAAN BRAND, S.L. (hereinafter, the “Organizer”) with fiscal address at Via Augusta 82, 6th Floor 08012 Barcelona and CIF nº B67343376, has decided to launch the “New Year New Giveaway” CONTEST (hereinafter, the CONTEST) with the aim of to promote HAAN products:
2. TERRITORIAL AND TEMPORARY SCOPE OF THE CONTEST
Territorial scope
2.1. The contest will be developed for an international scope.
Temporal scope
2.2. The CONTEST will begin on December 28, 2021 and will end on January 6, 2022, both inclusive (hereinafter, “PROMOTIONAL PERIOD”).
3. REQUIREMENTS TO PARTICIPATE IN THE CONTEST.
3.1. Participation in this CONTEST is free of charge, aimed at people over 16 years of age.
3.2. HAAN has the right to disqualify any participant who violates any of the provisions contained in this document. HAAN also reserves the right to verify by whatever procedure it deems appropriate that the winner complies with all the requirements of this document and that the data provided to HAAN are accurate and truthful. Among other issues, HAAN may request documentation from the participants to prove compliance with the participation requirements. Failure to provide this documentation may lead to the disqualification of the required participant.
3.3. The owners and employees of HAAN, as well as their respective relatives, ascendants, descendants, spouses or domestic partners are excluded from this CONTEST. Likewise, the organizer reserves the right to prevent speculation or business systems from being established on this CONTEST, in which case it may exercise those legal actions it deems appropriate.
3.4. HAAN will discard those entries that are abusive or fraudulent.
4. DRAW MECHANICS
To participate, the following requirements must be respected:
4.1 Subscribe to our database for sending Newsletters by HAAN
4.2 “Tag” a friend on Instagram in our CONTEST post published on Instagram
4.3 Participants may participate in the CONTEST as many times as they deem appropriate without being limited to a specific number of times per participant.
4.4 From among all the comments that meet the aforementioned requirements, HAAN, through random selection tools, will obtain 1 finalist. 1 finalist will be chosen randomly in @haanready's CONTEST post. In that same act, 1 alternate will be chosen, who will be awarded in the event that the winner chosen in the first place does not contact HAAN under the conditions established in section V or has been disqualified in accordance with the provisions of the present Legal Bases.
4.5 The prize will go to the participant who has been the winner. The prize is personal and intransferable.

The winner must respect the regulations. If it does not meet the criteria of these regulations, the award will not be awarded. Participants authorize all checks regarding their identity, age, postal address or the loyalty and sincerity of their participation. Any false declaration, indication of identity or address will imply the immediate elimination of the participant and, where appropriate, the reimbursement of the prize already assigned.
In no case will comments that violate the image of HAAN or against the following principles be accepted: right to honor, personal and family privacy, the dignity of the person, principle of non-discrimination based on race, sex, religion, opinion, nationality, disability or any other personal or social circumstance, as well as other principles that may be violated. Therefore, the Participants are responsible for these manifestations and, consequently, they will hold HAAN harmless against any claim from third parties.
5. NOTICE OF THE PRIZE
5.1. HAAN will indicate in the CONTEST post the profile of the winning user and will contact via DM with the winning user's account so that they can provide their data and shipping information.
5.2. The communication will be made on January 6, 2022 through the official Instagram profile @haanready
5.3. Once the previous communication has been made, the winner must send an intelligible private message to the official Instagram profile @haanready, within 24 hours, this is at most on Friday, January 7, 2022 at 11:59 p.m., to accept the prize and communicate your personal data.
5.4. If after this 24-hour period, no response is received from the winner, it will be understood that they renounce the prize and the alternate winners will be contacted.
5.5. In any case, if the substitutions are exhausted or for any other reason no winners are found, the award will be void.
5.6. Once the personal data has been received by the winner, on January 7, 2022, HAAN will contact the winner via private message to communicate the prize obtained, using the personal data provided by the winner.
5.7. HAAN will not be responsible for possible incidents in the delivery or any other circumstance attributable to third parties that affects the gifts of this CONTEST.
5.8. The award will be awarded to the winner within a maximum period of 30 days from the date of acceptance by the winner. However, if after attempts have been made to deliver the prize to the winner, said delivery is not made for reasons attributable to the winner, the winner will lose all right to receive the prize, as well as to exercise any related claim. Notwithstanding that other possible causes of non-delivery are considered attributable to the winner. The following will be considered imputable causes: having provided HAAN with wrong contact information, as well as not collecting the prize, leaving notice at the address provided by it, within the period stipulated in said notice.
5.9. The Organizer may publish the name of the winner online and offline, as well as the prize obtained, without conferring any right other than the delivery of the prize.
5.10. In no case will assignments of the prize to third parties be accepted or managed, nor will the winners have the right to receive its value in cash.
6. GENERAL PROVISIONS AND LIMITATION OF LIABILITY
6.1. HAAN reserves the right to vary any of the prizes and / or their characteristics if necessary, for example, due to supply problems, etc.
6.2. No exchange of any of the gifts for their economic value is allowed.
6.3. Although HAAN will do everything possible to avoid the provision of incorrect or false data or documents by the participants, HAAN will not be responsible for the veracity of the data or documents that they provide. Therefore, if the data or documents provided are not correct or have errors, HAAN will not be responsible for not being able to contact the possible winners to communicate the result, for not being able to manage with them the delivery of the prize and all the incidents that could derive from the incorrectness or falsity of the data or documents supplied.
6.4. The maximum period established for any type of claim referred to and / or related to the CONTEST expires two (2) months from the end of the same. After the end of this period, all right to claim will be lost.
6.5. This CONTEST is not sponsored, endorsed, administered, or associated in any way with Instagram. In this sense, the participants exonerate Instagram from all responsibility derived from their participation in the CONTEST.
7. ACCEPTANCE
7.1. Participation in this CONTEST implies full acceptance of these rules. The Organizer reserves the right to vary these bases if the circumstances so require and resolve any doubts that may arise in matters not provided for in them.
7.2. The Organizer also reserves the right to cancel, extend, cut or modify the CONTEST if circumstances require it, without having to justify the decision and without being able to claim any type of responsibility as a consequence of it, always in such a way that no harm the rights acquired by the participants.

8.1. The CONTEST will be communicated through the official HAAN Social Networks: Instagram @haanready
9. DATA PROTECTION.
9.1. The personal data supplied to participate in the CONTEST are intended for HAAN BRAND, S.L. with tax address at Via Augusta 82, 6th Floor 08012 Barcelona and CIF nº B67343376.
9.2. Your data will be used by HAAN to manage your participation in the CONTEST, for validation in the event of being named the winner, and to do HAAN commercial actions.

10. INTELLECTUAL PROPERTY
The winner expressly authorizes the use by HAAN of any statement made about the CONTEST and about the Prize both on the website and on HAAN's social networks.
11. TAXATION
11.1. Law 35/2006 of November 28, which approves the Personal Income Tax and partially modifies the Laws on Company Taxes, on Income, will be applied to the gifts of this CONTEST. of non-residents and on the patrimony and other concordant provisions and dictated in its development.
11.2. HAAN will be responsible for paying these withholdings, for which HAAN will deliver the withholding certificate for the fiscal year in which you enjoy the award so that it can be included in your income statement, taking into account the applicable rate at the time of awarding the award.
12. APPLICABLE LAW AND JURISDICTION
12.1 These bases will be governed and interpreted in accordance with their own content and by the laws of Spain. In case of divergence between the participants in the CONTEST and the interpretation of these rules by HAAN will be competent to hear any litigation that may be raised by the Courts and Tribunals of the city of Barcelona (Spain), expressly waiving the participants in this CONTEST at their own discretion if they do.
